1. Acceptance of Terms

By accessing or using buster.games ("the Site"), operated by Tensor Wave Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

2. Description of Service

buster.games is a free online game portal that provides browser-based games. No downloads or installations are required. Games are playable directly in your web browser at no cost.

3. Eligibility

The Site is intended for users aged 13 and older. By using the Site, you represent and warrant that you are at least 13 years of age. If you are under 13, you are not permitted to use the Site for any purpose. 5. User Conduct

You agree not to:

• Reverse engineer, decompile, or extract the source code of any games or site components
• Use automated tools to scrape, crawl, or otherwise collect data from the Site
• Attempt to gain unauthorized access to any part of the Site or its systems
• Use the Site for any unlawful purpose
• Download, copy, or redistribute game files without explicit permission

6. Third-Party Content

Some games on the Site may be developed by third-party developers. We are not responsible for the content, quality, or functionality of third-party games. Individual games may be subject to their own terms and licenses. The Site may contain links to third-party websites that we do not control or endorse.

7. Disclaimer of Warranties

The Site and all games are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Games may contain bugs or may not function correctly on all devices or browsers.

8. Limitation of Liability

To the fullest extent permitted by law, Tensor Wave Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages.

In no event shall the aggregate liability of Tensor Wave Inc. arising out of or related to these Terms or the Site exceed one hundred U.S. dollars (US$100). This limitation applies regardless of the theory of liability, whether based in contract, tort (including negligence), strict liability, or any other legal theory.

9. Indemnification

You agree to indemnify and hold harmless Tensor Wave Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

10. Dispute Resolution & Arbitration

Binding Arbitration:Any dispute, controversy, or claim arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in the State of Delaware, or at your election, may be conducted remotely (by telephone or videoconference). The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

30-Day Opt-Out Right: You may opt out of the arbitration and class action waiver provisions by sending written notice to hey@tensorwave.co within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration clause.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.

EU/UK Carve-Out: If you are a resident of the European Union or the United Kingdom, this arbitration clause does not apply to you. You retain the right to bring claims in the courts of your country of residence in accordance with applicable local laws, including consumer protection regulations.

11. Termination

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for any reason, including violation of these Terms.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Site (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Site or any of its features or content.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in the State of Delaware.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tensor Wave Inc. regarding your use of the Site, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction and without notice to you, including in connection with a merger, acquisition, reorganization, or sale of assets.

18. Force Majeure

Tensor Wave Inc. shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, power failures, internet or telecommunications failures, government actions, or any other event beyond our reasonable control.

19. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20. Electronic Communications Consent

By using the Site, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
