DMCA / Copyright Policy

1. Respect for Intellectual Property

Tensor Wave Inc. respects the intellectual property rights of others and expects users of buster.games to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

2. Filing a DMCA Takedown Notice

If you believe that content on buster.games infringes your copyright, please send a written notice to our designated agent with the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the game page).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Processing Timeline

Upon receiving a valid DMCA takedown notice, we will:

  • Acknowledge receipt of the notice promptly
  • Review and process takedown requests within 5 to 10 business days
  • Notify the affected content provider or user of the takedown

Counter-notifications will be processed within 10 to 14 business days of receipt. If the original complainant does not file a court action within that period, we may restore the removed content in accordance with DMCA procedures.

5. Counter-Notification

If you believe your content was removed in error due to a DMCA notice, you may submit a counter-notification to our designated agent including:

  • Your physical or electronic signature
  • Identification of the material that was removed and the location where it appeared
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the party who filed the original DMCA notice

6. Misrepresentation Warning (17 U.S.C. § 512(f))

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether material hosted on the Site infringes your copyright, we recommend consulting an attorney before submitting a DMCA notice or counter-notification.

7. Repeat Infringers

In accordance with the DMCA, we will terminate access for users or content providers who are repeat infringers in appropriate circumstances.

8. Trademark Infringement

If you believe that content on the Site infringes your trademark rights, please contact us at hey@tensorwave.co with the following information:

  • Your name and contact information
  • Identification of the trademark you claim is being infringed, including registration number (if applicable)
  • Identification of the material you claim is infringing and its location on the Site
  • A description of how the material is infringing your trademark
  • A statement that you have a good faith belief that the use is not authorized by the trademark owner, its agent, or the law

We will review trademark infringement claims on a case-by-case basis and take appropriate action, which may include removal of the infringing material.
